In a blow to prosecutors, the new trial for rape allegations against Harvey Weinstein in New York ended on Friday without a unanimous jury decision, leading the judge to declare a mistrial. The former Hollywood producer, already convicted in other cases, remains incarcerated. This case involved accusations from Jessica Mann, a former aspiring actress who claims she was raped in a Manhattan hotel room in March 2013.

Manhattan District Attorney Alvin Bragg expressed disappointment in the outcome, noting that the victim has been seeking justice for over a decade. The prosecutor stated they will decide on next steps in consultation with Mann, taking into account Weinstein’s pending criminal conviction. This was the third trial related to this case, following the cancellation of the 2020 conviction and the previous jury’s inability to reach a verdict in 2025.

During her testimony in New York’s Supreme Court, Jessica Mann described seeing Weinstein at the time as a “miracle” that such an influential man wanted to be her “mentor.” The defense argues that the sexual relationship was consensual. Weinstein’s attorneys released a statement saying the prosecution should stop retrying the same case, emphasizing that two juries couldn’t agree unanimously, indicating a reasonable doubt.

Harvey Weinstein, 74, is also challenging his 2023 conviction in California for a 16-year prison sentence for raping a European actress. In New York, he was convicted last year in another case involving the sexual assault of Miriam Haley in 2006, which he has appealed. Since 2017, over 80 women have accused the former Miramax founder of sexual misconduct.
