Military programming law: state of alert, former spies… These measures which are causing debate

Défense. The military programming bill, examined in the Assembly, arouses strong criticism. At issue: a very controversial “state of national security alert”, and planned restrictions on the speech of former intelligence agents.

The draft update of the military programming law (LPM) has been examined in the National Assembly since Monday, May 4. It is also closely scrutinized by associations and public opinion, who point to several measures considered problematic. This bill, presented last July by Emmanuel Macron, sets the main directions and resources of the French armies by 2030. In particular, it provides for an additional 36 billion euros, to reach a total budget of 436 billion. But also the creation of a “state of national security alert”, which is curiously reminiscent of the already existing state of emergency.

This mechanism would be activated in part or all of the territory by decree adopted by the Council of Ministers, and would allow, according to the Minister of the Armed Forces Catherine Vautrin, “to respond quickly in complex situations”. “In the event of a threat and when circumstances require it”, this “new framework” must make it possible “to temporarily adapt our rules to accelerate decisions, simplify procedures, remove blockages”, Prime Minister Sébastien Lecornu also detailed at the end of March before the National Assembly.

“A state of emergency that does not speak its name”

In a column published on May 3, several associations and unions, including the Human Rights League, France Nature Environnement, the Magistrates’ Union and the CGT, denounced the creation of this tool. According to them, it would notably allow exemptions from labor law, environmental law and even heritage law. But above all, “what worries us is that it is in reality a state of emergency which does not say its name and which would be triggered by the government on absolutely vague and vague criteria”, denounced Monday on France Inter Nathalie Tehio, president of the League of Rights of the man.

Concretely, according to TF1/LCI, this regime would make it possible to strengthen the security perimeter of sensitive sites, to facilitate the storage of ammunition or fuel, to accelerate the deployment of “French or allied” armed troops or even “to accelerate the construction of additional camps and logistical infrastructure.” The channel also claims that private security agents at certain sensitive sites would be empowered and trained to defend themselves against potential drone attacks.

The newspaper The World also reported last month that the text provides that certain constraints could be lifted, allowing the State to initiate requisitions not only from arms manufacturers, but also “from an entire civil and health logistics chain”. The objective is to “enable France to ensure its role as a European rear base” in the event of conflict on the eastern flank of Europe.

“Censorship” of former spies

Another measure, less engaging for the country but also controversial, is attracting criticism. Article 17 of the LPM provides for requiring validation of books, research articles, conferences, columns or documentaries produced by agents or ex-agents of the intelligence services French. A provision considered contrary to freedom of expression by many intellectuals. In detail, the article provides that for ten years after leaving office, an agent “who wishes to publish or distribute a work of the mind […] which concerns the activities of one of the services is required to make a declaration to the minister responsible […] and to transmit to him the Work […] before publication”, under penalty of criminal sanctions.

For the State, certain content may be “likely to undermine the secrecy of national defense or certain services or specialized units”. This measure concerns in particular certain former agents of the General Directorate of External Security (DGSE) converted into writers. If most already submit their manuscripts before publication, a precedent has left its mark: in 2023, the former head of post in Libya Jean-François Lhuillier was arrested for “violation of professional secrecy”, “revelation of information allowing the identification of a source” and “compromise of the secret of national defense” after the publication of his book The Man from Tripoli. He faces up to seven years in prison and a fine of 100,000 euros.

The publisher Louis de Mareuil, for his part, warned Libération against “the significant risk of a form of censorship of manuscripts relating to little-known periods of our recent history, in which the services played an important role and which deserve to be told, such as France Africa or Algeria”.
