Juan Ayala-Montero, 60, was charged on Monday, court records show. If convicted of the charge, he could face up to 15 years in federal prison and a fine of up to $250,000. Ayala-Montero, who also faces state charges of felony deadly conduct, was in custody at the Montgomery County Jail with bail set at $80,000 as of Tuesday.
Ayala-Montero had been removed from the United States in 2006 and was prohibited from re-entering the country, according to the U.S. Attorney's Office. U.S. Immigration and Customs Enforcement have issued an immigration detainer for Ayala-Montero, the Montgomery County Sheriff's Office said.
Federal prosecutors allege that just before 5 p.m. Saturday, Ayala-Montero used a .223 AR-style rifle, with a scope attached, to fire at multiple people in the 19000 block of Nottingham Road in the Kings Colony neighborhood. One victim, Uziel Samano, 17, was hospitalized after being shot in the torso and the head, but was released after treatment. Law enforcement officials said they recovered the rifle from Ayala-Montero's bedroom and said about 30 spent casings were found at the scene.Â
Ayala-Montero had been hanging out and drinking with a group of people in the neighborhood when an argument broke out, a witness told federal investigators, according to the criminal complaint. Ayala-Montero, nicknamed “El Michoacano,†then said he had something for the group, went into his residence, came out with a rifle and began shooting at the ground, according to witnesses cited in complaint. Members of the group tried to calm him down, but Ayala-Montero said he was going to kill them, a witness told authorities.
Another witness, one of Ayala-Montero's neighbors, took refuge with his two children in a camper van during the shooting, according to the criminal complaint. Law enforcement officials found at least one bullet hole in the van. Other people hid inside a building until officers arrived, per the complaint. Ayala-Montero initially barricaded himself inside his home but he eventually surrendered and was taken into custody, officials said.
Samano was also charged with a misdemeanor for making a false report to a police officer.
A date has yet to be set for Ayala-Montero's first appearance in federal court, according to court records.
