“Violation of Freedom of Conscience” In November, a federal judge initially ordered the removal of these texts. This injunction has now been overturned by the federal appeals court in New Orleans. The court’s decision states that the obligation to display this text does not constitute “an infringement on the freedom of conscience of Texas students or parents” and that the plaintiffs “have not shown that (the law) constituted a substantial infringement on their right to freedom of worship.” The appeals court also believes that the law does not violate the First Amendment of the Constitution prohibiting the establishment of a national religion and favoring one faith over another. This decision could set a precedent that might encourage other states to impose similar measures.
The ACLU, however, has said it plans to appeal to the Supreme Court. “We are extremely disappointed by the decision made today. The court’s decision goes against the fundamental principles of the First Amendment and the binding jurisprudence of the United States Supreme Court,” the ACLU said in a statement. Texas Attorney General Ken Paxton, a Republican, applauded the appeals decision. “The Ten Commandments have had a profound impact on our nation, and it is important for students to learn from them every day,” he wrote.
The appeals decision noted that “countless public schools – including those in Texas – already begin the day by reciting a pledge leading students to state a nation united under the authority of God.”
