A Violation of the American Constitution
The procedure, revealed by the CBS channel, was brought before a Washington court by the heads of the minority Democrats in Congress, Chuck Schumer (Senate) and Hakeem Jeffries (House), the association of governors, and the national party steering committee. The plaintiffs argue that Donald Trump is exceeding his powers and violating the American Constitution, which does not give the federal government direct authority over the organization of elections, a power reserved for the states.
The decree “drastically restricts Americans’ ability to vote by mail, encroaching on the traditional authority of the states,” they argue in a 64-page document denouncing an “illegal exercise of power that must be invalidated.” Mail-in voting has long been in the crosshairs of President Trump. He frequently claims that this practice, which has been widely used in the United States since the Covid-19 pandemic, is responsible for fraud, an assertion that has never been supported by evidence.
For years, the American president has been railing against an electoral system that he believes is biased against him and has never acknowledged his defeat in the 2020 presidential election to Joe Biden. The American Supreme Court rejected in mid-March a challenge to mail-in voting, specifically addressing the acceptability of ballots received after election day but postmarked no later than the day of the vote.
